DRUG TRAFFICKING DEFENSE

 

 

Whereas drug possession charges usually fall under misdemeanors, drug trafficking can be considered a felony and/or a federal offense. This means you could be charged with a significantly more serious crime, and thus, a harsher punishment. 

What is drug trafficking?

Trafficking is the intent to distribute, manufacture, or sell CDS (controlled dangerous substances). If convicted, trafficking carries much harsher punishments than possession, with a minimum of 10 years in prison to a maximum of life in prison and high fines.

What are the penalties?

Penalties depend on the substance, the amount, whether you're charged with trafficking or aggravated trafficking, if the offense is state or federal, and other factors surrounding the case. For instance, Schedule 1 drugs (marijuana, crack cocaine, LSD, meth, and heroin) are considered the most dangerous and easily abused drug, with little to no medical benefit. Obviously, this has changed in regards to marijuana and the state of Oklahoma recognizes its medical purposes, though it is still currently considered a Schedule 1 drug. Trafficking Schedule 1 or 2 drugs is considered aggravated trafficking which carries the harshest punishments.

Can I get a lesser sentence?
